1.     Scope of application

(1) The present General Terms and Conditions (hereinafter referred to as "GTC") of "Dutyfit by Marco Tanner" shall apply to the utilization of all services, offers, and products of "Dutyfit by Marco Tanner". By making use of them, the customer accepts the present General Terms and Conditions.

2.     Health

​

(1) The customer takes up the training voluntarily and on his own responsibility.

(2) The client confirms that he/she is in good health and that from a medical point of view there are no significant physical limitations or acute injuries.

3.     Use of the services and offers

​

(1) The minimum age for customers is 18 years. Provided that a declaration of consent from the parent or legal guardian is available, training can also be taken up before reaching the age of 18.

​

4.     Subscriptions

​

(1) Subscriptions are personal and non-transferable.

(2) Any non-utilization of the training offer by the customer does not entitle the customer to a refund or a reduction of the subscription price.

(3) The duration of the contract is regulated in the respective contract. Programming membership contracts are automatically renewed.

5. Prices and payment

​

(1) The currently valid prices are available online.

(2) Trainings and subscriptions are to be paid directly by deposited credit card upon conclusion of the contract or renewal of the contract.

(3) "Dutyfit by Marco Tanner" reserves the right to adjust prices and possible discount regulations at any time and without prior notice.

6.     Cancellation

​

(1) Subscriptions may be cancelled online at any time.

(2) A refund or reduction of the subscription price is excluded in any case.

7.     Liability and Insurance

​

(1) "Dutyfit by Marco Tanner" expressly disclaims any liability for damages resulting from accidents, injuries and/or illnesses of the customer.

(2) The conclusion of an insurance is the responsibility of the customer.

8.     Data protection

​

(1) The customer acknowledges and agrees that personal data will be used and stored exclusively for the execution of the contract and for information purposes. Data will not be passed on to third parties, in particular for commercial purposes.

(2) The documents, information, etc. (e.g. training plans or YouTube videos) provided to the customer in the course of a training are intended exclusively for the customer's own private use. A transfer and the provision to third parties and / or copying of the corresponding documents, information, etc. is not allowed.

9.     Changes to the General Terms and Conditions

​

(1) "Dutyfit by Marco Tanner" may amend the GTC at any time without prior notice. These shall be brought to the attention of the customer in an appropriate form. Changes may also be made by publication on the Internet.

10.   Applicable law and place of jurisdiction

​

(1) All legal relationships of the customer with "Dutyfit by Marco Tanner" are exclusively subject to Swiss law.

(2) The exclusive place of jurisdiction for all proceedings shall be the Canton of Vaud.
